ONE SOURCE GROUP, the manufacturer of SULTRA Solid Surface, warrants to the original end-use purchaser that its product is free from defects in material and workmanship under normal use and service for a period of ten years from the date of sale to the original end-use purchaser.
Exclusion from coverage
This warranty does not cover:
(1) Minor conditions such as stain, scratches, water spot and burn which may be corrected
as set forth in the care and cleaning instructions provided herewith;
(2) Slight color variations, which may be due to the unique properties of SULTRA Solid
Surface;
(3) Improper fabrication or installation;
(4) Damage caused by acts of natural disaster such as fire, flood, wind and lightning.
(5) Damages caused by unauthorized attachements and modifications;
(6) Damage during shipment;
(7) Any products moved from their original place of installation; or
(8) Any other abuses or misuse by the consumer.
Repair or Replacement
If the purchaser discovers within the warranty period a defect in material or workmanship, the purchaser must promptly notify ONE SOURCE GROUP in writing. Within a reasonable time after notification, ONE SOURCE GROUP, Inc. with its discretion will either repair or replace the SULTRA Solid Surface product purchased. Repair or replacement will be the expense of ONE SOURCE GROUP and shall include the reasonable labor charges needed to repair or replace the defective product, but not removal, repair, or replacement of fixtures, hardware or decorative treatment (such as floor, wall or ceiling treatments). ONE SOURCE GROUP shall not be liable in either tort or contract for any loss or direct, consequential or incidental damages arising out of the use or inability to use the SULTRA Solid Surface product even if the manufacturer fails in its attempt to repair or replace the product.
Transferability of Warranty
This warranty is transferable from the original end-use purchaser to any other consumer end-user within the 10-year period only when the new consumer end-user writes to ONE SOURCE GROUP (see address below) to register the product under the new end-user's name. Care and cleaning instructions will be sent to the new owner detailing the proper maintenance of the product.
Warranty Exclusion
THE FOREGOING WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANT ABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
Some states do not allow the exclusion of limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. This warranty gives you specific legal right, and you may also have other right which vary from State to State. No fabricator, installer, dealer, agent or employee of the manufacturer has authority to increase or alter the obligation or limitation of this warranty.
